Can You Get Arrested for Speeding in Florida?

Generally, a speeding ticket is not a serious enough offense to warrant an arrest, but there are circumstances under which you may be arrested.

For example, if you were driving at a speed that substantially exceeded the speed limit, you risk an arrest. While you may not be arrested for traveling 100 mph on the Florida turnpike at 2 am, you face near certain arrest if you were doing so at rush hour since your conduct was reckless and significantly threatened the safety of others.

Multiple Violations

Another circumstance where a speeding violation could result in your arrest is if you have multiple speeding violations or if you commit some other offense along with speeding such as driving while under the influence of alcohol or if you were speeding well over the speed limit and you caused an accident involving a serious bodily injury.

Also, if you were 50 mph or more over the speed limit and this is your third offense, you can be charged with a third degree felony, which carries up to 5 years in prison, a fine up to $5000 and a 10 year revocation of your driver’s license. A felony offense will result in you being arrested.
